1. Acceptance of Terms

By accessing or using Kolsense.ai ("the Service"), operated by ActivePulse Media and owned by Diego Ilan Tevelev, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Kolsense.ai is an AI-powered calling platform that initiates and conducts phone conversations on behalf of users for lead qualification, first introductions of products, services, or companies, outreach, follow-ups, and related communication tasks. Where configured by the user, the Service may transfer relevant or qualified calls to a human representative. The system operates using voice synthesis, speech recognition, and related AI technologies.

3. User Accounts

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• You must be at least 18 years old to use this Service.
• You must provide accurate and complete information when creating your account.
• You are responsible for all calls made through your account.

4. Acceptable Use

You agree to use Kolsense.ai only for lawful purposes. You may not use the Service to:

• Impersonate any person or entity fraudulently
• Conduct scam calls, harassment, or any form of abuse
• Violate any applicable local, national, or international law
• Use a phone number that does not belong to you as your caller ID
• Record calls without the knowledge of the other party where required by law
• Call people without having the required consent or lawful basis, or in violation of do-not-call, telemarketing, anti-spam, privacy, AI disclosure, or consumer protection rules

5. Phone Numbers and Caller ID

Kolsense.ai provides access to shared outbound calling numbers as part of its services. Users may also obtain dedicated virtual phone numbers as an optional paid add-on. Dedicated numbers are provisioned through third-party telecommunications providers and maintained on a recurring basis. They may be used to support consistent caller identification and local presence when making calls. There is no fixed limit on the number of dedicated phone numbers a user may obtain, subject to availability, technical restrictions, and applicable law. Users are responsible for the proper use of any numbers assigned to their account in compliance with all applicable laws and regulations.

6. Call Recording and Transcription

Kolsense.ai records and transcribes calls made through the platform. By using the Service, you acknowledge that calls will be recorded. You are solely responsible for complying with applicable call recording laws in your jurisdiction, including notifying the other party where required.

7. Subscription and Billing

Kolsense.ai offers both free and paid subscription tiers. Paid subscriptions are billed monthly unless otherwise agreed in writing. Paid plans may include a monthly allocation of call units. Additional units may be purchased or added to a specific account separately. Business plans are custom and may include custom fees, custom unit allocations, dedicated numbers, usage-based billing, or other commercial terms agreed in writing. Payment is currently processed manually - upon requesting an upgrade, you will be contacted by ActivePulse Media to arrange payment. All fees, purchased units, and dedicated number charges are non-refundable except as described in our Refund Policy or where required by applicable law.

8. Intellectual Property

All content, technology, software, designs, branding, AI configuration, and materials provided by Kolsense.ai are the property of ActivePulse Media and/or Diego Ilan Tevelev. You may not copy, modify, distribute, resell, reproduce, or reverse engineer any part of the Service except where expressly permitted in writing.

9. Limitation of Liability

Kolsense.ai is provided "as is" without warranties of any kind. ActivePulse Media shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lead quality, answer rates, sales, conversions, transfers, call completion, AI output, transcription accuracy, service availability, or the outcome of any lead qualification, introduction, follow-up, transfer, or call conducted by the AI.

Dashboard statistics, analytics, insights, knowledge gap reports, summaries, classifications, scores, and other AI-generated or system-generated metrics are provided for reference and operational convenience only. They may be incomplete, delayed, misclassified, or inaccurate, and should not be treated as definitive facts, professional advice, or the sole basis for business, legal, educational, medical, financial, or other important decisions. You are responsible for independently reviewing and verifying any information before relying on it. If you identify a possible error, you are encouraged to notify us so we can review and improve the Service.

10. Termination

We reserve the right to suspend or terminate your account at any time if we determine that you have violated these Terms. You may also delete your account at any time by contacting us at support@kolsense.ai.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes by email or by displaying a notice on the platform. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of Israel. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tel Aviv, Israel.

13. Do Not Call and Opt-Out Rights

Kolsense.ai is committed to honoring opt-out requests from individuals who are contacted through the platform. The following applies to all automated calls made via Kolsense.ai:

• Immediate opt-out: If a person verbally requests to be removed from a calling list during an AI-conducted call (e.g., "don't call me again", "remove me from your list"), the call is terminated immediately and the number is automatically added to a Do Not Call list for that account.
• No further contact: Once a phone number is added to the Do Not Call list of an account, it will not be dialed again by that account's campaigns or automated calls.
• User responsibility: Platform users are responsible for ensuring that they have the required consent or lawful basis before initiating calls to any individual, in accordance with applicable telemarketing, privacy, and consumer protection laws in their jurisdiction.
• Contact for opt-out requests: Individuals who wish to request removal from all communications associated with the platform may contact us at support@kolsense.ai.

14. SMS Messaging

Kolsense.ai enables users to send SMS messages from their dedicated number directly from the call history panel. SMS is an optional feature available to accounts with a dedicated phone number assigned and SMS capability enabled.

• Cost: 2 units are deducted per SMS sent. Estimated cost is approximately $0.19 per message based on the Starter plan ($29 / 300 units). Actual cost may vary by plan tier.
• Available destinations: Israel, United Kingdom, Germany, Spain, Italy, Sweden, Cyprus, and most European countries, as well as LATAM and Australia. France may require carrier pre-registration — delivery is not guaranteed.
• Not yet available: United States and Canada. SMS to US/Canadian numbers requires 10DLC registration, which is currently pending. This service will be activated and announced once regulatory requirements are met.
• No refunds: Units deducted for sent SMS messages are non-refundable, even if the message was undelivered due to carrier filtering or regional restrictions.
• Compliance: Users are solely responsible for ensuring they have appropriate consent or legal basis before sending SMS messages to any recipient, in accordance with applicable anti-spam, privacy, and consumer protection laws in their jurisdiction.
• Opt-out: Recipients who request removal from SMS communications must be honoured immediately. The platform records DNC status but does not automatically filter SMS recipients — users must check DNC status before sending.

15. Add-on Services

Kolsense.ai offers optional add-on services that extend the functionality of a base subscription. These currently include:

• Biz Widget ($39/month) — An embeddable AI voice widget for your business website. Available as a paid add-on for Starter and Premium plan subscribers. Business plan subscribers receive this feature included at no additional charge.
• Edu Widget (from $49/month, quoted by proposal) — An AI-powered tutoring widget for educational platforms. Pricing is individually quoted based on estimated monthly usage volume and must be explicitly activated by Kolsense.ai following a separate proposal and agreement.

Add-on services are billed monthly in addition to the base subscription fee. Activation of an add-on constitutes agreement to these Terms and the applicable Refund Policy. Add-ons are subject to the same Acceptable Use and Content policies as the base Service. Kolsense.ai reserves the right to adjust add-on pricing with 30 days' notice to active subscribers.

1. קבלת התנאים

בשימוש או בגישה ל-Kolsense.ai ("השירות"), המופעל על ידי ActivePulse Media ובבעלות דיאגו אילן טבלב, את/ה מסכים/ה להיות כפוף/ה לתנאים ולהגבלות אלה. אם אינך מסכים/ה לתנאים אלה, אין לעשות שימוש בשירות.

2. תיאור השירות

Kolsense.ai היא פלטפורמת שיחות מבוססת בינה מלאכותית, היוזמת ומנהלת שיחות טלפון בשם המשתמשים לצורכי סינון לידים, היכרות ראשונית עם מוצר, שירות או חברה, פנייה יזומה, מעקב אחר פניות ומשימות תקשורת נוספות. כאשר המשתמש מגדיר זאת, השירות עשוי להעביר שיחות רלוונטיות או לידים מתאימים לנציג אנושי. המערכת פועלת באמצעות טכנולוגיות סינתזת קול, זיהוי דיבור וטכנולוגיות AI נוספות.

3. חשבונות משתמש

לשם שימוש בשירות יש ליצור חשבון עם כתובת דוא"ל וסיסמה תקפות. המשתמש אחראי לשמירה על סודיות פרטי הגישה שלו ולכל פעילות המתבצעת במסגרת החשבון.

• יש להיות בני 18 ומעלה כדי להשתמש בשירות.
• יש למסור מידע נכון, מדויק ומלא בעת יצירת החשבון.
• המשתמש אחראי לכל השיחות המתבצעות דרך החשבון שלו.

4. שימוש מותר

המשתמש מתחייב להשתמש ב-Kolsense.ai למטרות חוקיות בלבד. אין לעשות שימוש בשירות לצורך:

• התחזות לאדם או גוף אחר במרמה
• ביצוע שיחות הונאה, הטרדה או כל צורה אחרת של שימוש פוגעני
• הפרת דין מקומי, לאומי או בינלאומי החל על המשתמש
• שימוש במספר טלפון שאינו שייך למשתמש כזיהוי מתקשר
• הקלטת שיחות ללא ידיעת הצד השני כאשר הדין מחייב גילוי או הסכמה
• ביצוע שיחות ללא הסכמה או בסיס חוקי נדרש, או בניגוד לכללי רשימות אל-תתקשרו, טלמרקטינג, ספאם, פרטיות, גילוי שימוש ב-AI או הגנת הצרכן

5. מספרי טלפון וזיהוי מתקשר

Kolsense.ai מספקת גישה למספרי טלפון משותפים לביצוע שיחות יוצאות כחלק מהשירות. בנוסף, ניתן להקצות מספרי טלפון וירטואליים ייעודיים כתוספת אופציונלית בתשלום. מספרים ייעודיים מוקצים באמצעות ספקי תקשורת צד שלישי ומתוחזקים על בסיס מתמשך, וניתן להשתמש בהם לצורך זיהוי מתקשר עקבי ויצירת נוכחות מקומית בעת ביצוע שיחות. אין הגבלה קבועה על מספר המספרים הייעודיים שניתן להקצות לחשבון, בכפוף לזמינות, מגבלות טכניות והוראות הדין. המשתמש אחראי לשימוש תקין במספרים המשויכים לחשבונו בהתאם לכל דין.

6. הקלטת שיחות ותמלול

Kolsense.ai מקליטה ומתמללת שיחות המתבצעות דרך הפלטפורמה. בשימוש בשירות, המשתמש מאשר כי שיחות יוקלטו. האחריות הבלעדית לעמידה בדיני הקלטת שיחות, לרבות חובת הודעה לצד השני ככל שנדרשת, חלה על המשתמש.

7. מנויים וחיוב

Kolsense.ai מציעה מסלולים חינמיים ומסלולים בתשלום. מנויים בתשלום מחויבים על בסיס חודשי, אלא אם הוסכם אחרת בכתב. מסלולים בתשלום עשויים לכלול מכסת יחידות חודשית לשיחות. ניתן לרכוש או להוסיף יחידות נוספות לחשבון מסוים בנפרד. מסלולי Business הם מסלולים מותאמים אישית ועשויים לכלול דמי שימוש מותאמים, מכסת יחידות מותאמת, מספרים ייעודיים, חיוב לפי שימוש או תנאים מסחריים אחרים שיוסכמו בכתב. נכון לעכשיו, התשלום מעובד באופן ידני; לאחר בקשת שדרוג תיצור עמך ActivePulse Media קשר לצורך הסדרת התשלום. כל התשלומים, יחידות שנרכשו וחיובים בגין מספרים ייעודיים אינם ניתנים להחזר, למעט כמפורט במדיניות ההחזרים שלנו או ככל שהדין מחייב אחרת.

8. קניין רוחני

כל התוכן, הטכנולוגיה, התוכנה, העיצוב, המיתוג, הגדרות ה-AI והחומרים המסופקים על ידי Kolsense.ai הם קניינם של ActivePulse Media ו/או דיאגו אילן טבלב. אין להעתיק, לשנות, להפיץ, למכור מחדש, לשכפל או לבצע הנדסה לאחור לכל חלק מן השירות, אלא אם ניתן לכך אישור מפורש בכתב.

9. הגבלת אחריות

Kolsense.ai מסופקת "כמות שהיא" וללא אחריות מכל סוג, מפורשת או משתמעת. ActivePulse Media לא תישא באחריות לכל נזק ישיר, עקיף, אגבי או תוצאתי הנובע מהשימוש בשירות, לרבות איכות לידים, שיעורי מענה, מכירות, המרות, העברות שיחה, השלמת שיחות, תוצרי AI, דיוק תמלול, זמינות השירות או תוצאה של סינון ליד, היכרות ראשונית, מעקב, העברה לנציג או כל שיחה שבוצעו באמצעות ה-AI.

התובנות והסטטיסטיקות מיועדות להתייחסות בלבד ועלולות לכלול אי-דיוקים. אין להתייחס אליהן כעובדות מוחלטות, כייעוץ מקצועי או כבסיס יחיד להחלטות חשובות. על המשתמש לבדוק ולאמת את המידע באופן עצמאי. אם מצאתם טעות, נשמח שתעדכנו אותנו כדי שנוכל לבדוק ולשפר את השירות.

10. סיום או השעיה

אנו שומרים לעצמנו את הזכות להשעות או לסיים חשבון בכל עת אם נגיע למסקנה כי המשתמש הפר תנאים אלה. המשתמש רשאי גם לבקש מחיקת חשבונו בכל עת באמצעות פנייה לכתובת support@kolsense.ai.

11. שינוי התנאים

אנו רשאים לעדכן תנאים אלה מעת לעת. נודיע למשתמשים על שינויים מהותיים באמצעות דוא"ל או באמצעות הודעה בפלטפורמה. המשך השימוש בשירות לאחר פרסום השינויים יהווה הסכמה לתנאים המעודכנים.

12. דין וסמכות שיפוט

תנאים אלה כפופים לדיני מדינת ישראל בלבד. כל מחלוקת תהיה בסמכות השיפוט הבלעדית של בתי המשפט המוסמכים בתל אביב, ישראל.

13. רשימת אל-תתקשרו וזכות הסירוב לקבלת שיחות

Kolsense.ai מחויבת לכיבוד בקשות הסרה מאנשים שנוצר עמם קשר דרך הפלטפורמה. להלן מדיניות הפלטפורמה לגבי כל שיחה אוטומטית המתבצעת דרכה:

• הסרה מיידית: אם אדם מבקש בעל-פה להסיר את מספרו מרשימת השיחות במהלך שיחה שמנהל ה-AI (למשל: "אל תתקשרו אליי שוב", "הסירו אותי מהרשימה"), השיחה מסתיימת באופן מיידי והמספר מתווסף אוטומטית לרשימת אל-תתקשרו של אותו חשבון.
• הפסקת פניות: לאחר הוספת מספר טלפון לרשימת אל-תתקשרו של חשבון, לא ייחייג אליו שוב במסגרת קמפיינים או שיחות אוטומטיות של אותו חשבון.
• אחריות המשתמש: משתמשי הפלטפורמה אחראים לוודא כי קיימת הסכמה נדרשת או בסיס חוקי לפני ביצוע שיחות לאנשים, בהתאם לדיני הטלמרקטינג, הפרטיות והגנת הצרכן החלים בתחום שיפוטם.
• פנייה להסרה: אנשים המעוניינים לבקש הסרה מכל תקשורת הקשורה לפלטפורמה מוזמנים לפנות אלינו בכתובת support@kolsense.ai.

14. שליחת SMS

Kolsense.ai מאפשרת למשתמשים לשלוח הודעות SMS ממספרם הייעודי ישירות מפאנל היסטוריית השיחות. SMS הוא פיצ'ר אופציונלי הזמין לחשבונות עם מספר טלפון ייעודי מוקצה ויכולת SMS מופעלת.

• עלות: מנוכות 2 יחידות לכל SMS שנשלח. העלות המשוערת היא כ-$0.19 להודעה בתוכנית Starter ($29 / 300 יחידות). העלות בפועל עשויה להשתנות לפי מסלול התוכנית.
• יעדים זמינים: ישראל, בריטניה, גרמניה, ספרד, איטליה, שוודיה, קפריסין ורוב מדינות אירופה, כמו גם אמריקה הלטינית ואוסטרליה. לצרפת עשוי להידרש רישום מוקדם אצל הספק - המשלוח אינו מובטח.
• טרם זמין: ארצות הברית וקנדה. שליחת SMS למספרים אמריקאיים וקנדיים דורשת רישום 10DLC, שנמצא כרגע בהליך. השירות יופעל ויפורסם עם עמידה בדרישות הרגולטוריות.
• אי-החזר: יחידות שנוכו עבור הודעות SMS שנשלחו אינן ניתנות להחזר, אפילו אם ההודעה לא הגיעה ליעד בשל סינון ספק או מגבלות אזוריות.
• עמידה בדרישות החוק: המשתמש אחראי אישית להבטיח שיש לו הסכמה מתאימה או בסיס חוקי לפני שליחת הודעות SMS לכל נמען, בהתאם לדיני אנטי-ספאם, פרטיות והגנת הצרכן החלים בתחום שיפוטו.
• הסרה: יש לכבד מיידית בקשות הסרה של נמענים מתקשורת SMS. הפלטפורמה מתעדת סטטוס DNC אך אינה מסננת אוטומטית נמעני SMS - על המשתמשים לבדוק את סטטוס ה-DNC לפני שליחה.

15. שירותי תוספות

Kolsense.ai מציעה שירותי תוספות אופציונליים המרחיבים את פונקציונליות המנוי הבסיסי. שירותים אלה כוללים כיום:

• ווידג'ט ביז (39$ לחודש) - ווידג'ט קולי מבוסס AI להטמעה באתר העסק. זמין כתוספת בתשלום למנויי Starter ו-Premium. מנויי Business מקבלים שירות זה כחלק מהמנוי, ללא תשלום נוסף.
• ווידג'ט חינוכי (מ-49$ לחודש, לפי הצעת מחיר) - ווידג'ט מדריך AI לפלטפורמות חינוכיות. התמחור מחושב בנפרד לפי היקף השימוש החודשי המשוער, ויש להפעיל אותו על ידי Kolsense.ai בעקבות הצעה והסכם נפרד.

שירותי התוספות מחויבים מדי חודש בנוסף לדמי המנוי הבסיסי. הפעלת תוספת מהווה הסכמה לתנאים אלה ולמדיניות ההחזרים הרלוונטית. שירותי התוספות כפופים לאותן מדיניות שימוש מותר ותוכן החלות על השירות הבסיסי. Kolsense.ai שומרת לעצמה את הזכות לשנות את תמחור התוספות בהודעה מוקדמת של 30 יום למנויים פעילים.
