1. Acceptance of Terms

By accessing or using Kolsense.ai ("the Service"), operated by ActivePulse Media, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Kolsense.ai is an AI-powered call assistant platform that conducts phone calls on behalf of users for the purposes of negotiation, inquiry, complaint resolution, and other conversational tasks. The AI operates using voice synthesis and speech recognition technologies.

3. User Accounts

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• You must be at least 18 years old to use this Service.
• You must provide accurate and complete information when creating your account.
• You are responsible for all calls made through your account.

4. Acceptable Use

You agree to use Kolsense.ai only for lawful purposes. You may not use the Service to:

• Impersonate any person or entity fraudulently
• Conduct scam calls, harassment, or any form of abuse
• Violate any applicable local, national, or international law
• Use a phone number that does not belong to you as your caller ID
• Record calls without the knowledge of the other party where required by law

5. Phone Number Verification

To use your personal phone number as a caller ID, you must verify ownership of that number via SMS verification. By verifying a number, you confirm that you are the rightful owner or authorized user of that number.

6. Call Recording and Transcription

Kolsense.ai records and transcribes calls made through the platform. By using the Service, you acknowledge that calls will be recorded. You are solely responsible for complying with applicable call recording laws in your jurisdiction, including notifying the other party where required.

7. Subscription and Billing

Kolsense.ai offers both free and paid subscription tiers. Paid subscriptions are billed monthly. Payment is currently processed manually — upon requesting an upgrade, you will be contacted by ActivePulse Media to arrange payment. All fees are non-refundable except as described in our Refund Policy.

8. Intellectual Property

All content, technology, and materials provided by Kolsense.ai are the property of ActivePulse Media. You may not copy, modify, distribute, or reverse engineer any part of the Service.

9. Limitation of Liability

Kolsense.ai is provided "as is" without warranties of any kind. ActivePulse Media shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to the outcome of any negotiation or call conducted by the AI.

10. Termination

We reserve the right to suspend or terminate your account at any time if we determine that you have violated these Terms. You may also delete your account at any time by contacting us at info@activepulse.co.il

11. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes by email or by displaying a notice on the platform. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of Israel. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tel Aviv, Israel.
